Terms Of Service

1. Definitions:

In this Agreement, each of the following terms and expressions shall have the meaning stated next to it, unless the context indicates otherwise:

1.1. "Agreement" – terms and conditions set forth in these Terms of Use, and any and all additional terms and conditions relevant to the Package and/or the Service, as specified on the Website or otherwise communicated on behalf of the Company to the Customer.

1.2. "Company" – ITC IP Technologies ltd.

1.3. "Customer" – person or entity entering into the Agreement with the Company, for the purpose of provision of the Service by the Company to such person or entity.

2. The Service:

2.1. Registration to the Service or purchase of the Service by Customer in any form constitute the Customer's acceptance of these Terms of Use and the Agreement, and Customer's entrance into the Agreement, and constitute Customer's representation that she/he has read and understood these Terms of Use and any and all additional terms and conditions relevant to the Package and/or the Service, as specified on the Website, and that she/he is of legal age to enter into the Agreement. Any person who does not agree to any of the terms and/or conditions of the Agreement, whether entirely or partly, must refrain from registering to or otherwise purchasing the Service.

2.2. In any event, customer is liable to pay for the calls which he made according to Company records. If there are any differences between the Company's records, and other party call records, the Company's records will be the one to apply.

2.3. It is the customer's responsibility to safe guards his account settings for his needs only. It is the customer's responsibility to inform the Company in case his account was used un-properly and needed to be disconnected. Customer will pay and be responsible for all account's expenses until disconnection time by the Company.

2.4. The Company keeps the right to modify the numbers assigned to customer by advance notification.

2.5. All prices are shown in US$ or Israeli NIS and do not include Israeli VAT where applicable.

2.6. Where applicable, minimum US$ exchange rate to NIS is 4NIS=1US$

2.7. The service does not comply with USA e911 regulations and should not be relayed upon for emergency services.

2.8. In some cases the service might not be available to prefix 972.1XX (Israel special services).

2.9. The right to use a number does not imply any ownership rights or others, on this number, given to the customer by the Company. All rights in numbers are being held by the Company and are not passed to the customer and not implied as such.

2.10. Using the service might requires a suitable internet connection.

2.11. Duration of service: Duration of service agreement is 30 days, with automatic renewal, unless notified otherwise by customer.

2.12. Payment for service: Billing for each month will be done at the end of its previous month.

2.13. Canceling of service: Canceling of service by customer at any time, by sending an email. The email must contain the user's name and phone number to be canceled and sent to support@IsraelNumber.com.
In order to prevent fraud, the email's return address must match the one the Company has on file for this user.
The service and its charges will stop in end of the following month from time given.
Please request us to confirm receiving your cancellation request.

2.13.1. As part of our service, ITC will check and insure to provide the customer with a Dubai (971x) SPAM free tag, checked on Truecaller.com. ITC does not warranty other locations provided to be free of SPAM tags and will not replace them free of charge, as such.

2.13.2. Dubai (971x) local numbers cancelled by customer, which are found to present SPAM tag on Truecaller.com at time of cancellation, will be charged a one-time patiently fee of 120$, per number to customer's account.

2.14. Money deposited in the pre-paid account cannot be refunded and can be used for calls only.

2.15 Calls to numbers starting with 1 (example, toll-free, emergency service, information service and more) will be billed as a call to landline number for that destination.

2.16 Allocated numbers can be replaced, at no cost by our support team, if found not to support the service they intend to provide.

2.17 Once allocated, ITC does not deploy any automated way to insure the numbers proper functionality. The customer has the right to test the allocated number, at any time and frequency deemed to be needed, report any issue found to our support.

2.18 Where applicable, minimum incoming call duration is 60 seconds

3. Limitation of Liability

3.1. The Customer acknowledges that the Service, by its nature, is susceptible to interruptions, that the Service is provided on an “as is” or “as available” basis, with all faults, and that the Company does not undertake that the Service will be available at all times nor that it will be free of interruptions.

3.2. Without derogating from any other provision herein concerning interruption and/or discontinuance of the Service, the Service may be interrupted owing to essential or maintenance works on any of the systems/infrastructures used to provide it.

3.3. The Customer acknowledges that portions of the Service are provided by third parties over which the Company has no control, and that the Company shall not be liable for any act or omission of such third parties, and the Customer undertakes not to make any claim and/or demand against the Company with relation thereto.

3.4. Provision of the Service is subject to, among other factors, telephone line availability and the condition of the telephone devices used.

3.5. EXCEPT AS OTHERWISE SPECIFICALLY SET FORTH IN THESE TERMS OF USE, THE COMPANY (INCLUDING ITS OFFICERS, EMPLOYEES, AND ANY AFFILIATES) AND ITS SUPPLIERS DISCLAIM ANY AND ALL WARRANTIES WITH RESPECT TO THE SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

3.6. In no event shall Company (including its officers, employees, and any affiliates), or any of its suppliers or third parties providing services with relation to the Service be liable for: (a) any direct, indirect, punitive, special, consequential, or incidental damages, including, without limitation, lost profits or loss of revenue arising with relation to the use or inability to use the Service (including, without limitation, the inability to access emergency services via the Service), whether under contract, tort, negligence, or strict liability, even if the Company had been advised of the possibility of such claim or damages, or (b) any claim against the Customer by any third party.

4. Lawful purposes

4.1. You acknowledge and agree to use any of Company's Websites or Services solely for lawful purposes. In this respect you may not, without limitation (a) intercept or monitor, damage or modify any communication which is not intended for you, (b) use any type of spider, virus, worm, trojan-horse, time bomb or any other codes or instructions that are designed to distort, delete, damage or disassemble any of Company's Websites or Services or the communication, (c) send any unsolicited commercial communication not permitted by applicable law, or (d) expose any other user to material which is offensive, harmful to minors, indecent, unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, violate the rights of others, or otherwise violate any applicable local, state, national or international law or otherwise objectionable.

You will be responsible for, and indemnify and hold harmless Company against any claim arising from any material that you post or transmit.

5. Miscellaneous

5.1. The Company maximum liability to the customer or his beneficiary will be equal to the amount actually paid by the customer to the Company.

5.2. The Company reserve the right to modify this Term Of Service agreement. Modifications will apply to new and current customers as well.

5.3. The Company reserve the right to modify its prices upon its sole discretion. Notice of price changes will be given 30 days in advance.

5.4. This Agreement shall be construed and enforced in accordance with the laws of the State of Israel. All disputes settled by final and binding court decision in Tel Aviv, Israel.

5.5. Shipping when needed, will be done insured and registered unless specified differently.

5.6. All offers are valid while supply last.

5.7. The Company reserves the right to change this Terms of Service at any time. Changes shall become effective within thirty (30) days of publication of the revised version on www.IsraelNumber.com/tos.asp. Your continued use of your subscription after expiry of the 30-day period shall constitute your acceptance to be bound by the terms and conditions of the revised Terms of Service policy.

GPRD compliance

1) Lawful, fair and transparent processing

ITC will process the personal data in a lawful, fair and transparent manner. All processing will be based on a legitimate purpose. ITC will take responsibility and will not process data for any purpose other than the legitimate purposes. ITC will inform data subjects about the processing activities on their personal data.

2) Limitation of purpose, data and storage
ITC will limit the processing of data, collecting only the data which is necessary, and will not keep personal data once the processing purpose is completed. ITC will forbid processing of personal data outside the legitimate purpose for which the personal data was collected. ITC will mandate that no personal data, other than what is necessary, be requested. The personal data will be deleted once the legitimate purpose for which it was collected is fulfilled.

3) Data subject rights
The customers have been assigned the right to ask ITC what information it has about them, and what ITC does with this information. In addition, a customer has the right to ask for correction, object to processing, lodge a complaint, and ask for the deletion or transfer of his or her personal data.

4) Consent
As and when the company has the intent to process personal data beyond the legitimate purpose for which that data was collected, a clear and explicit consent will be asked from the customer. Once collected, this consent will be documented, and the customer will be allowed to withdraw his consent at any moment. Also, for the processing of children’s data, GDPR requires explicit consent of the parents (or guardian) if the child’s age is under 16.

5) Personal data breaches
ITC will maintain a Personal Data Breach Register and, based on severity, the regulator and data subject will be informed within 72 hours of identifying the breach.

6) Privacy by Design
ITC will incorporate organisational and technical mechanisms to protect personal data in the design of new systems and processes; that is, privacy and protection aspects will be ensured by default.

7) Data Protection Impact Assessment
To estimate the impact of changes or new actions, a Data Protection Impact Assessment will be conducted when initiating a new project, change, or product.

8) Data transfers
ITC has the accountability to ensure that personal data is protected and GDPR requirements respected, even if processing is being done by a third party.

9) Data Protection Officer
When there is significant processing of personal data in an organisation, ITC will assign a Data Protection Officer.

10) Awareness and training
ITC will create awareness among employees about key GDPR requirements, and conduct regular trainings to ensure that employees remain aware of their responsibilities with regard to the protection of personal data and identification of personal data breaches as soon as possible.
